While X Factor hopeful Nicola-Marie isn't looking like she's about to set the charts on fire, she's still be told to remove previously released songs on iTunes.
The 'new rule' as brought in last month after Nicola's fellow auditionee Lucy Spraggan shot into the Top 40 with one of her previously released tracks.
Last Night was originally vying for the top spot before bosses asked Lucy to remove the songs, but the track still managed to make in to the charts at an impressive number eleven on Sunday night.
Now Nicola's been told to remove her tracks, including one called Freaky Night, which had been released under the name Nikia Aniston.
A spokesperson for The X Factor told The Sun last night: "All contestants have been asked to remove their recordings as it is essential all the contestants are treated fairly during the competition and, where possible, receive the same exposure.
"Nicola-Marie is in the process of removing the recording.”
